These general terms and conditions (the “General Conditions”) apply when you as an individual consumer (the “Buyer”) places an order using inpieces.eu and all of its related pages, (the “Website”). The agreement is a contract concluded between you and InPieces through its owner Poragora, Lda. Merchant Location Rua 5 de Outubro, 75 BL A Loja 1, 3500-107 Viseu, Portugal. Portuguese reg. no. 510 340 156. Detailed contact information and other information about us is shown on the Website. The General Conditions are applicable especially for buyers that are individuals/ consumers.
1) The Buyer must be a minimum of 18 years old to place an order via the Website. InPieces does not, in accordance with Portuguese law, accept any credit purchases from persons below the age of 18 years. InPieces reserves the right to deny or makes changes to a Buyer’s order (e.g. if the Buyer has provided inaccurate personal data and/or has any record or indication for non-payment of debt).
2) InPieces shall not be liable in case products are sold out, nor in the case of image or typographical errors on the Website, e.g., errors in the product description or other specifications, inaccurate prices and price adjustments or incorrect information as to whether a product is in stock. InPieces is entitled to rectify such errors and, at any time, to change or update all relating information. In case an inaccurate price has been stated for a product ordered by the Buyer, InPieces will naturally notify the Buyer immediately and await the Buyer’s approval of the changed price prior to InPieces's continuation of the order process. All images on our Website shall be considered solely as illustrations. Such illustrations do not guarantee to reproduce the exact appearance, function, or origin of the product. InPieces is not responsible for any information provided by third parties on the Website.
3) The Website and all its content is owned by InPieces or its licensors. All information is protected by intellectual property and also marketing legislation. This means that trademarks, product names, company names, designs, images and graphics, layout and information about products, services and all other content may not be copied or used, without the prior written consent of InPieces.
Contracts and orders
a) To be able to place an order using the Website, the Buyer has to accept the General Conditions. By accepting these General Conditions, the Buyer undertakes to comply with all of the General Conditions in its entirety and also acknowledges that he/she has read all the information on personal data and cookies and also consents to the use according to InPieces’s Privacy Policy set forth here.
b) A purchase agreement is concluded when InPieces has confirmed the Buyer’s order. This is done when the Buyer has received an order confirmation from InPieces via e-mail. InPieces encourages the Buyer to always save the order confirmation in case of any future contacts with InPieces’s buyer service regarding the order. The Buyer has the right to cancel its order up until the time when it has been confirmed by InPieces. If the order is cancelled, InPieces will refund all payments the Buyer has made as payment for the order.
c) InPieces is a B2C and B2B company and directly sells to private individuals and Non-EU corporations when buying through the webstore. InPieces will provide a payment receipt with all goods that have been purchased including Buyer Country VAT if there is any and the Buyer information that have been provided in the checkout.
d) EU Corporate clients: Please proceed to check-out but do not pay your order until you have received an email from us. If you are a corporation with in the EU and can provide a valid VIES Number, we will validade your information online and if you are a client liable for the reverse-charge procedure, we will issue you a valid VAT invoice and receipt with your purchase including your VAT and the Buyer information that have been provided in the checkout.
Buyer information
When the Buyer places an order, the Buyer will be asked to provide some personal or corporate information. The Buyer confirms that the information provided in its entirety is correct and complete and The Buyer is responsible for any errors in this information provided. Information about InPieces’s processing of personal data is stated in InPieces’s Privacy Policy, which constitutes a integral part of these General Conditions.
Fees, prices and payment
a) The prices stated on the Website always apply to orders placed on the Website. All prices are presented in Euro and include VAT at the applicable rate. The prices do not include handling and shipping fees or any other expenses or duties that may apply to the order and depending on the type of Buyer.
b) The Buyer can pay for its purchase in any manner specified on the Website. InPieces is entitled to charge the Buyer in connection with the order. InPieces also reserves the right not to offer all payment methods, at all times, and alternatively to change the payment method if the payment method the Buyer has selected does not work. This is applicable for whatever reason, at the time of fulfillment of the order. Limitations of available payment methods are set forth on the Website.
Complaints and warranty
a) The right to file a complaint applies to products that are defective according to applicable consumer protection legislation. In case the Buyer wishes to assert their right to file a complaint for any product ordered, they shall contact InPieces, as soon as possible after the defect was discovered,, but within 14-days, using the contact information set forth on the Website.
b) InPieces will carry the cost for the return freight for any approved complaints.
c) Once a product is returned, for which a complaint has been filed, and the complaint approved, InPieces will refund the Buyer in accordance with applicable consumer protection legislation. InPieces always strives to do so within 14-days from receipt of the complaint by The Buyer, but it may be delayed depending on the nature of the product. InPieces reserves the right to refuse any complaint, if the product in compliance with applicable consumer protection legislation, proves not to be defective. In the case of complaints InPieces complies with the guidelines provided by Portuguese Consumer Law.
Force Majeure
InPieces is not liable for any delays caused by circumstances beyond InPieces’s control, e.g., general labor dispute, changed governmental orders, acts of war, fire, lightning, terrorist attacks, technical problems, defects in power- /tele-/computer communications or other communication and defects or delays in the service by sub-suppliers due to circumstances set forth above. Such circumstances shall result in relief from damages and other measures. If any such situation should arise, InPieces shall inform the Buyer accordingly both at the beginning and the end of the period for the current situation. If the situation has lasted for more than two months, both the Buyer and InPieces are entitled to terminate the purchase with immediate effect.
InPieces reserves the right to change these General Conditions at all times. Any changes to these General Conditions will be posted on the Website. Changes become valid once the Buyer has accepted the General Conditions, this in connection with a new purchase or while browsing the Website, alternatively 30 days after InPieces has informed the Buyer of the changes. InPieces recommends however that the Buyer regularly stays up to date on the Website in order to become aware of any changes to the General Conditions.
In case any provision of this Agreement is held to be invalid or unenforceable by any competent court, authority or arbitral tribunal, the remainder of that provision and all other provisions will remain valid and enforceable to the fullest extent permitted by applicable law. Any provisions determined invalid or unenforceable will be substituted by relevant legal guidance and advice.
Any disputes shall primarily be settled by agreement after discussions with InPieces’s buyer services. In the event of any dispute, InPieces complies with the decisions of the Portuguese National Board for Consumer Complaints.
